UP plans lower costs for rental agreements

The Uttar Pradesh government is planning to change its tenancy regulations in order to make rental agreements much more affordable for tenants. The reforms focus on reducing stamp duty and registration costs in a bid to encourage formal rental contracts while addressing disputes arising from informal set-ups.
This move aims to make it easier for people renting homes across the state to document their agreements.
One of the key reasons behind these changes is the high costs of registering rental agreements. Registration charges are linked to the demands of rent and circle rates. This increases the financial burden on landlords and tenants. These expenses discourage people from registering their rental agreements.
Under Indian law, occupancy of more than one year is required to be registered. However, people opt for shorter agreements to avoid these costs and registration requirements. Uttar Pradesh Minister of State for Stamp and Registration Fees has announced plans to reform stamp duty rates of Rs 1,000 for rental agreements where the annual rent is Rs 2 lakh. This change is intended to make formal documentation accessible while implementing the Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021.
Lower registration costs could encourage more tenants to enter into a formally documented rental arrangement. A registered agreement can help in establishing the agreed rent, duration of tenancy, security deposit, and other conditions. This documentation can become important in the event of any dispute. For instance, if any landlord tries to forcefully evict a tenant without any prior notice, a registered agreement can act as important evidence.
These proposals help the landlords in maintaining the record of tenancy’s duration, payment obligations, and conditions for vacating the property. This can help in dealing with unpaid rent, breaches of contract, or disputes that involve tenants who remain in the property after their agreement is over. Formal agreements help in improving transparency by clearly establishing the obligations of both parties from the beginning of the tenancy.
The government hopes that lower documentation costs will ensure registration of rental agreements and reduce disputes due to lack of paperwork. If this is implemented effectively, the proposed changes can help in formalising Uttar Pradesh’s rental housing market.
