How Long Can The Income Tax Department Scrutinise Your Return?

Many taxpayers assume a processed income-tax return is final. It may not be. The department’s time to examine a case depends on whether it is regular scrutiny or reassessment for income believed to have escaped assessment.

Scrutiny And Reassessment Are Different

A scrutiny notice seeks supporting information on a filed return. Reassessment can begin later where the department finds undisclosed income or material that warrants a fresh look.

“The basic rule is that the department can reopen a case up to three years from the end of the relevant assessment year. Do not assume that a few years of silence means you are in the clear,” says Amitraj Kaushal, advocate, Supreme Court of India.

Where alleged escaped income exceeds Rs 50 lakh, the reopening window can extend to 10 years, according to Kaushal. The applicable limit depends on the law for that assessment year and the case facts.

Data Mismatches Can Draw Attention

The tax department now receives information through Form 26AS, Annual Information Statement (AIS), Taxpayer Information Summary (TIS), Form 16, Tax Deducted at Source (TDS) and Tax Collected at Source (TCS) reporting, as well as statements of financial transactions. A mismatch does not by itself establish wrongdoing, but it can prompt a request for an explanation or documents.

“Mismatch between income reported in the return and information available in Form 26AS, AIS & TIS. Difference between salary income reported in the return and Form 16,” says Darshak Shah, RRC Committee Chairman.

Large cash deposits or withdrawals, property purchases or sales, substantial investments in shares, bonds, mutual funds, fixed deposits or recurring deposits, big credit-card spends and high-value foreign travel may also be reported through Statement of Financial Transactions (SFTs). Taxpayers should reconcile such entries before filing.

“I have seen people get notices for things as simple as a mismatch between their Form 16 and what their employer filed in the TDS return. The system is now connected enough that even small inconsistencies get picked up,” says the advocate, Supreme Court of India.

Keep Records Long After Filing

Deductions and exemptions need the same discipline. Claims under Sections 80C, 80D, 80G and Housing Rent Allowance (HRA), as well as capital-gains exemptions, should be backed by documents. Where assessment, appeal or litigation is pending, records should be retained until the matter is finally concluded.

“Claiming deductions without adequate supporting documents. Excessive or unusual deductions under sections such as Section 80C, 80D, 80G, HRA. Incorrect exemption claims relating to Capital gains, Agricultural income & Exempt allowances,” says the RRC Committee Chairman.

For basic tax records, a seven-year storage habit offers a practical buffer. Property documents deserve longer retention because purchase, stamp-duty and improvement records may be needed years later to calculate capital gains.
