The US CLARITY Act is a long-awaited development for the global crypto industry as lawmakers work towards establishing a clearer regulatory framework for digital assets. While the legislation is focused on the US market, it is being watched globally, given the country's role in crypto markets and institutional investment.

What Is The CLARITY Act

The Clarity Act, also referred to as the Digital Asset Market Clarity Act, is a proposed US legislation that aims to establish clearer federal rules for cryptocurrencies and digital assets. The bill aims to divide the regulatory responsibilities of the Securities and Exchange Commission and the Commodity Futures Trading Commission in the crypto sector. If the bill passes, this can change how digital assets are regulated in the US.

Where Does The CLARITY Act Stand

The CLARITY Act passed the US House of Representatives with bipartisan support in 2025 and cleared the Senate Banking Committee as well in May 2026. It now needs to clear the Senate floor, where a 60-vote threshold is required, before the House and Senate can reconcile their versions and send the legislation to the President.

According to media reports, the Senate is expected to take up the bill in September.

The potential impact of the legislation on the wider crypto market remains a key area of discussion among industry participants.

What Could This Mean For Indian Investors

For Indian investors, the significance of the US legislation lies largely in how changes in the global crypto market could affect assets.

Rajagopal Menon, Vice President, WazirX, said, “The biggest potential impact is clearer responsibility between the SEC and CFTC, along with defined standards for exchanges, brokers and custodians.” He added that the impact will not be immediate. If the Act becomes law, the agencies will still need to write and implement the rules.

Edul Patel, CEO, Mudrex, said, “This matters for Indian investors as developments in the US can influence global liquidity, institutional participation, and overall market sentiment.”

Rajagopal Menon, Vice President, WazirX, said, “The CLARITY Act does not change the obligations of Indian investors. It provides a reference for how another major market is approaching these questions.”

He added that for Indian investors, the impact is likely to appear first in globally traded assets such as Bitcoin and Ethereum, while domestic liquidity will still depend on Indian taxation, banking access and platform-level market depth.

Where Does India Stand On Crypto Regulation

India does not recognise cryptocurrencies as legal tender, but crypto trading and holding are allowed. Edul Patel, CEO, Mudrex, said, “In India, crypto is currently governed primarily through taxation and anti-money-laundering requirements rather than a comprehensive crypto-specific market framework.”

Crypto assets are covered under the Virtual Digital Asset (VDA). Income from VDA transfers is taxed at 30 per cent, while a 1 per cent TDS applies on transfers, subject to applicable rules.
