A property may be considered disputed when there are conflicting ownership claims, pending court cases, unclear succession rights, or disagreements among family members regarding partition. In many cases, the deceased did not leave a Will behind to avoid this confusion and dispute. This, however, created uncertainty over who is entitled to inherit the property. The legal position of an heir depends on whether the property was self-acquired or ancestral.
“Heirs should feel better knowing that the law is clear about this. The moment the owner of the property dies, the right to inherit the property starts. You do not need a court order to say you can inherit the property. Just because someone else says the property is theirs it does not mean that the real heirs will not get the property. There may be a dispute that needs to be solved in court. This does not change the fact that the people who are supposed to inherit the property still have the right to do so. The property dispute may need to go through the process, but it does not take away the rights of the people who are entitled to inherit the property,” says Vivek Kumar, advocate, Delhi High Court.
Rights Of Legal Heirs
Under the Indian succession laws, legal heirs generally inherit the rights and obligations that are associated with the property after the owner has died. If a property dispute already exists, the heir steps into the legal position of the deceased and can continue pursuing the asset before the court.
Heirs can not be deprived of their lawful share because a dispute is pending; hence, courts often recognise their need to participate in legal proceedings and protect the rightful interest of the property.
“What heirs often don’t realise is that a dispute does not freeze their rights — it only means those rights may need to be asserted before a forum. You can seek an interim injunction from a civil court to prevent any third-party from alienating, encumbering, or physically taking over the property while the dispute is pending. Courts today are increasingly willing to grant such relief to protect the status quo. Disputes may delay your full enjoyment of the property, but they cannot, by themselves, defeat a legitimate inheritance. The law is clear — and it stands firmly behind the rightful heir,” adds Kumar.
Can The Property Be Sold?
A disputed property can be very hard to sell and unfair as well. Buyers are often reluctant to purchase such assets that are involved in litigation due to the future claims that can be staked on it. In many cases, ongoing court proceedings may restrict the sale of property until the dispute is resolved. Before attempting a sale, heirs should seek legal advice to ensure they understand any restrictions that are liable on the property.
Legal Remedies Available
Indian law offers several remedies to heirs who are dealing with disputed property. They can file for a partition suit to seek division of a jointly owned property, challenge fraudulent transfers, contest forged documents or seek injunctions to prevent the unauthorised sale by others. The court also allows the stakeholders of the property to resolve the matter outside of court through mediation and settlement.
Inheriting a disputed property does not mean inheriting a liability. While legal battles can be stressful and time-consuming, Indian law provides fair and just methods to safeguard the heirs and the rightful owners of the property.
