Allahabad High Court Slaps Penalty On Man For Misusing Legal Process To Financially Exploit His Wife

In a strong condemnation against the misuse of legal aid provided in matrimonial disputes, the Allahabad High Court has imposed a penalty of Rs 15 lakh on a man who had exploited his wife financially and then sought maintenance from her by concealing and withholding the key facts.

What Happened?

The couple got married in 2019, which followed a series of financial transactions that were initiated during the marriage. The dispute surrounds these transactions. The wife, who was a government employee, was pursued by her husband to take loans in her name that amounted to nearly Rs 25.06 lakh. As per a report by the Economic Times, the husband used to persuade the woman to take loans and that the funds would be used to purchase land. He promised her a secure and stable future. Instead of doing as he promised, he diverted the money to himself while his wife continued to bear the burden of repayment.

The situation became unfair to the wife when the husband left their home, taking the money, along with his wife’s car and jewellery. Despite his own doings, he approached the court seeking maintenance from his wife. He stated that he had no independent source of income and was her dependent.

When the court examined the case, it found gaps in the drafts submitted by the husband. It was noted that he withheld the information that was crucial to the case, including the fact that he had already been granted interim maintenance by a family court in the previous proceedings. The court bench observed that he had submitted affidavits that were misleading and not entirely true in an attempt to pursue legal remedies, which was effectively ruled as abusing the judicial process.

The court emphasised that anyone who approaches the court to seek justice on any matter must provide full disclosure and honesty, especially in matters of such a level of sensitivity. It held that the husband’s conduct was a clear lack of bona fides, and his actions also amounted to an attempt to mislead the court for personal gain.

The court dismissed the petition filed by the husband and inflicted a penalty of Rs 15 lakh, asking him to pay the amount to his wife within six weeks of the order. The court further stated that if he fails to pay her back, the amount would be recovered as arrears of land revenue, helping the wife have a justified ruling.
