In a major relief for homebuyers across Uttar Pradesh, the state Real Estate Regulatory Authority (Rera) has activated an online complaint filing system against builders and promoters charging illegal transfer or processing fees during flat transfers. The move comes shortly after the implementation of the 10th Amendment to the UP RERA General Regulations, 2019, which introduced a clear cap on transfer-related charges.
What Has Changed?
The UP Rera has capped the transfer fee charged to legal heirs upon inheriting a flat at Rs 1,000. The regulator’s decision comes after multiple complaints were filed with the UP Rera, most of which mentioned how builders are charging arbitrary and additional amounts for flat transfers after the death of the original owner.
The fees have been capped as a part of the revision of Regulation 47 of Rera, which is related to administrative and standard fees. With the revision, builders and promoters can only charge a maximum fee of Rs 1,000 for transferring flats to their legal heirs.
Apart from the Rs 1,000 cap, the UP Rera has also introduced a revised transfer fee on non-family transactions. In such cases, builders can charge a maximum of Rs 25,000 for non-family transfers.
Which Documents Are Required For Transferring Flats
In order to successfully go through the transfer problem, legal heirs have to submit the following documents:
Death certificate of the original owner.
Succession certificate.
No-objection certificates (NOCs) from any other legal heirs, if applicable, are required.
How To File A Grievance?

Visit the official UP RERA Website and log in to the e-court system.
File Form-M: Navigate to the “e-Court” section and register a complaint under the same form.
Select Grounds: Under “Relief Sought”, select “Others”, and then choose the ground of complaint.
Submit Documents: Upload all required supporting paperwork (e.g., builder demand letters, payment receipts).
Pay Fee: Complete the filing by paying the prescribed complaint fee of Rs 1,000.
This new regulation ensures that the reforms made by the UP Rera body strengthens buyer confidence in the state’s real estate and resolves the long-standing issue faced by homeowners.
The decision is also expected to improve transparency by formalising a clear fee structure instead of individual builder policies which can be arbitrary in nature.
