The CLARITY Act, a major cryptocurrency regulation bill in the US, fell short of 60 votes in the US Senate required to move the legislation forward for the next round of voting. The procedural vote came after weeks of negotiations over the proposed framework for digital assets, with lawmakers still divided over several provisions of the bill. The setback leaves the US without the broader crypto regulatory framework that the legislation was intended to establish.

What Happened In The CLARITY Act Senate Vote

The Senate vote on September 15, 2026 saw 50 Senators vote in favour and 49 against the measure. The bill needed 60 votes to clear the procedural hurdle and move forward. Four Republicans, Jerry Moran, Susan Collins, Josh Hawley and Thom Tillis, joined Democrats in opposing the measure.

The vote was on advancing the legislation, rather than its final passage. The bill would establish a regulatory framework for digital assets and set out the roles of the US Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) in overseeing the sector.

Tillis had initially voted in favour of the bill, but later switched his vote to no in a procedural move, thereby keeping his options open to bring the measure back for reconsideration later, according to a Reuters report.

Senate Republicans had released revised text of the bill on September 13 in an effort to address concerns raised by the banking industry and some Democrats. The changes were not enough to secure the 60 votes needed to advance the legislation. 

The bill is now effectively on hold as Congress is set to leave Washington this month ahead of the November mid-term elections. The setback could also leave the SEC and CFTC to continue developing crypto rules under their existing authority.

What It Means For Crypto Regulations

The failed vote means the US will continue without a comprehensive federal framework for digital assets for now.

Ashish Singhal, co-founder, CoinSwitch said, “While the procedural vote does not determine the merits of the CLARITY Act, it means the US will continue to operate without a comprehensive federal market-structure framework for now.”

Singhal added that even if the bill does not ultimately pass in its current form, the issues it addresses remain relevant for regulators across jurisdictions.

For India, this outcome reinforces the importance of developing a clear domestic framework rather than allowing any other country to set the tone. “Digital assets need defined rules if the next phase of adoption is to be sustainable,” said Rajagopal Menon, vice president, WazirX.
