How Soon Should You Respond?

A taxpayer is usually given 15 days from the date of receiving the notice to correct the defect or reply to it.

Still, do not work only on that assumption. Read the notice and note the date mentioned there. That is the timeline that matters.

If there is a genuine difficulty in responding within the given period, the taxpayer can seek more time through the prescribed process.

Before making any changes, first see exactly what has been flagged. There is no need to reopen the entire return if the notice relates to one specific issue.

This is where delay can become a problem.

If the taxpayer does not correct the defect within the time available, the return can be treated as invalid. In practical terms, it may then be considered that a valid return was not filed for that assessment year.

Other consequences may follow depending on the case. Interest or penalty could arise, and the taxpayer may also face difficulty in carrying forward certain losses or claiming some tax benefits.

Where the applicable filing window is still open, filing a fresh or revised return may be possible. The better approach, however, is to deal with the defective-return notice when it comes and close the issue within the deadline.
