The Allahabad High Court asked the Uttar Pradesh government to provide details of the security rules for the retired high court judges. In the petition filed by the Association of Retired Supreme Court and High Court Judges, a bench of Justice Ajit Kumar and Justice Swarupama Chaturvedi passed an order, directing the Additional Advocate General (AAG), MC Chaturvedi, to provide details about these rules to the court.
The retired judges’ association filed the petition seeking security for them. The petitioner’s counsel, senior advocate Alok Kumar Yadav, along with one other advocate, raised concerns about retired judges’ security and stressed that the issues need to be addressed, per the media reports. The counsel argued that the judges who take an oath to work with no fear or favour need to be provided with a minimum security when they are present in public.
The counsel argued, "Minimum security, even a retired judge needs to have while he moves out in public. A constitutional post holder at least deserves this much protection to his life and his family after he demits office," per PTI. The court directed the AAG to provide the relevant security rules before it, if there are any, for the retired judges of the High Court.
The counsel of the retired judges' association also asked for remuneration parity of the retired judges in UP with the retired judges as per the 2021 rules of the State of Andhra Pradesh, which the Supreme Court of India has also endorsed.
In response, the AAG informed the court that there is already an order regarding this, passed by the state government on December 29, 2025. The AAG said that the order follows an earlier order of the Supreme Court. In this case, the Supreme Court had asked the Uttar Pradesh government to issue an order regarding the facilities provided to the retired Chief Justices and Judges of the High Court, as per the 2021 rules of the State of Andhra Pradesh.
The Allahabad High Court then directed the AAG to put the said order on record and file an affidavit regarding this within two weeks.
